Ask our Adviser - Enduring Power of Attorney


My mum set up an Enduring Power of Attorney around 20 years ago and as she has become frail and less mobile, I need to do more and more for her. Is this document still valid as I understand a new system now applies?

 

Yes, it is still a valid document but the old-style Power of Attorney only deals with financial matters. Healthcare issues require a Lasting Power of Attorney so the Enduing Power of Attorney may not cover everything. If she still has capacity, she could set up a Health and Welfare Lasting Power of Attorney to sit alongside.
