What is an EPA

Enduring Power of Attorneys were the predecessor of Lasting Power of Attorneys and could be set up prior to 1st October 2007 when the new provisions were introduced

They can be used at any time, unless any restrictions have been applied and unlike LPA’s do not need to be registered with the Courts first, but should be when the donor loses capacity.

You may find banks and financial institutions are less familiar with these documents but don’t let them tell you they are not valid.

Legally the EPA deals with financial matters and many people choose to set up a Health and Welfare Lasting Power of Attorney in addition to deal with care issues.
